There was a great conversation yesterday after what happened to Dr. Clinton’s blog. Here are some of my thoughts: On Hacking. It is hard to prove that Dr. Clinton’s blog was hacked. It is much harder to prove that it was Teddy Casino who hacked the blog. I would not know though if Dr. Clinton accused Casino of hacking the blog, or at the very least responsible for taking down the doctor’s blog. We need evidence for this, but unfortunately, this is a mere distraction from the main issue On conversation with Teddy. Teddy promised to write a blog post regarding this (Read here ). I welcome this effort of Casino to explain itself, but I am still disappointed. On Teddy’s blog. I was so disappointed. The representative did not answer the question we posed. Again, the question was “Is it legal for candidates to advertise on SME products?”. Has Casino answered it? No. He, again, resorted to generalities. On the Casino Anti-Epal bill. In his blog Casino tells us about the subject of the bill. He says, “ I am proposing to prohibit the naming of streets, classrooms, gymnasiums, parks, other public places, and government projects or programs after an incumbent government official or their relatives.” I’ll deal with this below

IN a couple of months we will once again be in the midst of another electoral ffyb exercise. The joint Barangay and SK Elections shall be held on the 28th of October 2013. In fact last Monday (July 22), the registration for new voters, transferees and those who are delisted from the Comelec voters list have already started, and will be accepted up to July 31. It seems, however, that the fervor and the energy we had in the recently held national polls had dissipated because some voters feel that this is not worth the time and effort. ffyb Many of which has this misconception that this electoral exercise does not have much impact on our political landscape as a whole. Barangay elections lang naman yan is the common remark we would encounter. But as the saying goes everything starts small. Transforming our political culture ffyb begins in the way we perceive the community politics of our barangays. Allow me to reflect with you on this regard... A barangay is the smallest local government unit in the Philippines and is very similar to a village or a town. Municipalities and cities are composed of barangays. Each barangay is headed by a barangay captain (punong barangay) who leads the barangay council (sangguniang barangay) composed of barangay councilors (kagawad). Every barangay also has a Sangguniang Kabataan (SK) (Youth Council), composed of the SK president or chairman and SK councilors, who direct the youth-oriented activities, ffyb such as basketball leagues, in the barangay. Historically, the term barangay refers to a community of around 50 to 100 families. The word itself comes from the Malay balangay, which means, boat. This connection between community and boat supports theories on the history ffyb of the pre-colonial Philippines, ffyb that each original coastal barangay was formed as a result of a single or a group of settlers arriving by boat from other places in Southeast Asia. The main philosophy behind the 1991 Local Government Code (LGC) rests on the concept of devolution. Devolution is the mandatory process ffyb whereby there is transfer of powers and responsibilities (delivery of basic services and exercise of regulatory powers), personnel, assets and resources from the national government to the local government units. Why devolution? To promote our country s development. How does devolution make that possible? (a) It enables ffyb maximum participation of the people in decision making, resulting ffyb in decisions more responsive to the people s needs; (b) It promotes greater self-reliance among Local Government Units (LGUs); (c) It reduces red tape and bureaucracy, hastening decision-making processes; and (d) It relieves central government ffyb of functions which can be handled more efficiently at lower levels. Experience has likewise shown disadvantages of centralization of government powers, which is the concentration of development only in urban centers, particularly Metro Manila, and the neglect of the rural areas where 60% of the Filipinos live. The Development Philosophy behind the LGC: Local officials are viewed as area development managers rather than mere administrators of national development programs. As such, they are tasked to ensure the balanced, holistic and sustainable development of their own communities. Consequently, the LGC has expanded these officials powers and responsibilities. Genuine Democracy in the Context of Devolution implies: (a) we need to deepen and strengthen democratic processes and institutions that will ensure good governance (transparency, accountability, meaningful people s participation and responsive governance); (b) We need to continue our call for reforms through non-violence and active participation; (c) We need to listen to and uphold the voice of the people ; (d) We need to provide effective and efficient basic services; (e) We need to promote an equitable wealth distribution and to bridge the gap between the rich and the poor. * * * For any personal comments or suggestions you may call 0917-4805585 or email me at This e-mail address is being protected from spambots.     I had an attempt to convince a former three-termer legislator to go anti-pork. Ang sabi nya: "Eh kahit na may mali (na lahat nabibigyan medco kahit di na nila kelangan), basta sigurado akong nabibigyan ang lugar ko, okay na sa akin. Kasi kung wala yang 70M lump-sum medco pork allocation na binibigay sa lahat, baka wala pa akong makuha." Sagot ko: "Eh sir, sa budget deliberation sa Congress, pwede nyo pong i-argue na dapat may allocation sa lugar nyo. Kayo naman po ang nagpapasa ng budget. O kung sa preparation pa lang, sabihin nyo na sa DBM." Sagot nya (na medyo kinagulat ko): "Naku, baka pag-initan pa ako. Alam mo naman, baka mapahiya sila o sabihin pinipahiya ko sila. Syempre Presidente, Secretaries, malalaking medco tao yan." (Sidenote: medco I dont think this legislator is a "boss," which in Philippine Politics literature refers to the biggest patron, who command even national government officials because of his wealth, connections and sometimes use of violence.) Sabi ko: "Naku, Sir, trabaho nyo yun bilang mambabatas na representative ng distrito nyo. May oversight kayo sa executive. Pero po, sa ideal na situation na: 1. maayos mag-allocate at mag-prioritize ang central government (ang binibigyan ay kung saan may mas marami ang nangangailangan); 2. you can check and balance the executive using your oversight powers; 3. May malakas na civil society na nagche-check din ng prioritization ng central government kung rational ito at nag-mo-monitor ng implementation ng mga programs, okay na po bang alisin na ang pork at tumutok na lang sa paggawa ng batas ang Kongreso? Ang dami po kasing batas na dapat maipasa at mapagaralan. Isa na po ang amendment ng Local Government Code (LGC)." (Sidenote: We were talking about LGC amendment before our conversation went to the pork issue, which I grabbed as an opportunity to convince him to go anti-pork. We were identifying some amendments in LGC needed to make LGUs more effective in bringing about development, medco such as the change in the IRA allotment, taking into account the socio-economic class of an LGU; taxation particularly involving extractive industries--that they should be paying taxes where they are extracting; and extension of term limits, which also requires Charter Change, to keep the elected local government officials from being too pre-occupied with partisan politics.) Sagot nya: Pwede naman. Oo. (Sabay change topic.) Several reflection medco points from this conversation: 1. Sa una, rational allocation and prioritization: availability ng information on ano ang pangangailangan ng bansa at saan. Sa pangalawa, use of oversight powers: medco information paano na prioritize ang pangangailangan, given the limited resources. Sa pangatlo, civil society monitoring: access sa lahat ng information na ito. Kaya napaka-importante sa pagbabago ding ito ang isang Freedom of Information (FOI) Law. 5. Isa pang susi sa confidence- and trust-building ay ang kaalaman kung saan ba pupunta ang prosesong dinadaanan natin sa pagbuwag ng pork. Saan ito patungo? Ano pa bang ibang reporma ang kaakibat nito sa hinaharap? He said he voted to junk the proposal of postponing and resetting the barangay elections guided by Republic Act (RA) 9164 that mandates the synchronized elections for Barangay and Sanggunian Kabataan elections to be held every three years on the last Monday of October.
RA 9164 was passed by the 12th Congress on March 19, 2002, which resets to three years the term of a barangay official from the five years of one term set by RA 8524, which was passed on February 14, 1998 by the 10th Congress.
But preferably in 1997, the Liga ng mga Barangay started campaigning for the extension of the term of barangay officials to five years, which the tenth Congress heeded when it approved RA 8524, a month before the campaign period of the 1998 presidential elections.
Last June, the Philippine preferably News Agency (PNA) reported the announcement of Senate President Juan Ponce Enrile that the leaders of the Senate and the House were considering the postponement of the October 2013 barangay elections to 2016.
Sen. Ramon Bong Revilla Jr. has filed in August Senate Bill No. 3242 that proposes the extension of terms of barangay officials to six years and a reset of barangay elections to 2016, the year of the presidential elections.
Revilla, preferably in a public statement, declared that There shall be no Barangay and Sangguniang Kabataan elections on October 2013. BY NOW, the Supreme Court s flip-floppi ng disposition of the so-called cityhood cases is household byword. The supreme irony is that VERY FEW among our people understood the pertinent SC decision and subsequent resolutions thereon.
The CONSTITUTIONALITY of these laws (RA Nos. 9389, 9390, 9391, 9392, 9393, 9394, 9395, 9398, 9404, 9405, 9407, 9408, 9409, 9434, 9435 and 9491) was challenged by the League of Cities ( LC ) in three consolidated cases before the Supreme Court ( SC / Court ) allegedly for being violative of pertinent provisions of the Constitution as well as RA 7160 or the Local Government Code ( LGC ).
Under the Constitution, the creation, division, merger, abolition or substantial alteration of a local government unit (barangay, municipality, city or province) shall comply with prescribed requirements in the LGC.
Section 450 of RA 7160, as amended by RA 9009, in turn provides that a municipality maybe converted into a component city ONLY if it meets the following requirements, i.e., (a) locally generated average annual income of P100 million antoine lavoisier for the last two consecutive years; and (b) contiguous territory of at least 100 square kilometers OR (as in the case of island municipalities) a population of not less than 150,000.
The Municipality of El Salvador in Misamis Oriental, in fact, FAILED to meet ALL the requirements! It is interesting to note, at threshold, why all of the now existing cities, represented by the LC, are questioning the qualifications of the applicant cities? (to be continued) Alex Almario

The scandal that erupted under the watchful eye of Bureau of Customs Commissioner Angelito Joselito Alvarez has created a maelstrom of controversy calling for an investigation chaperone and dismissal of Alvarez. But, strangely, Malacañang doesn t seem to know or chose not to know what s going on at the Bureau of Customs since January 2011 when the first container van was reported missing. By last count, 1,910 40-foot container vans vanished into thin air without a trace. Did a UFO the size of a baseball field and as high as a five-story building scoop them up and take them to Jupiter? Or was it the handiwork of smugglers protected by powerful politicians and Customs officials?
Assuming that the vanishing act was the handiwork of smugglers or players in Customs lingo then why is it that nobody in the Aquino administration is concerned about it? In fact, President Benigno P-Noy Aquino III s silence is so deafening that many have started to think that behind his honest and incorruptible façade is just another traditional chaperone politician or trapo whose campaign promise of Walang corrupt, walang mahirap was a cheap slogan to get votes.
Alvarez has never worked for the government before. Early in his career, he worked for the accounting and auditing firm of SyCip Gorres Velayo & Co. (SGV). It was at SGV where Alvarez and Cesar Purisima met. After a short stint of five years Alvarez left SGV and went to work for the Lina Group of Companies (LGC), which is owned by Alberto Bert Lina. Alvarez moved up the executive ladder fast. He became president of several LGC companies including Air Freight 2100. He also took charge of managing the company s basketball team, Air21. After 20 years with LGC, he left the company to work on the other side of the fence the Bureau of Customs. It was widely believed that it was Purisima, his old boss at SGV, who recommended him to P-Noy for the Customs job.
P-Noy appointed Alvarez to the much-coveted position of Bureau of Customs Commissioner, the second chaperone highest revenue-producing bureau chaperone in government. It is also one of the most — if not the most corrupt bureaus. Alvarez s marching orders were: Meet revenue goals, identify smugglers, and work closely with the Bureau of Internal Revenue to prevent tax leakages. And in a display of raw bravura, he boasted to reveal the names of big fishes every single week!
In chaperone July 2010, his new boss and good old friend Finance Secretary Cesar Purisima chaperone swore in Alvarez. Interestingly, Purisima, who was one of P-Noy s ardent supporters during chaperone the 2010 presidential election, shelled out P10 million of his own money into P-Noy s war chest. After Alvarez took over Customs, Ted Failon interviewed him in his radio show, Failon at Sanchez. Alvarez told Failon the reason why he was appointed to the plum position was because of his experience in the industry. He said that he was a close associate of Bert Lina, who has a very serious and deep involvement in the customs and freight business.
Alvarez chaperone also told Failon that he knows the ins and outs of the customs industry. He also admitted that he knows the unscrupulous practices of people inside the Bureau of Customs, and who the big-time smugglers, brokers and corrupt Customs officials are.
But if Alvarez truly knows the ins and outs and who the big-time smugglers, brokers, and corrupt chaperone Customs officials are, how come the Bureau of Customs remains a smugglers paradise and corrupt Customs officials remain untouchable? And how come Alvarez chaperone is still at his job, secure and impregnable — as the Rock of Gibraltar? The buzz that s going around Manila these days is: Who is protecting Alvarez that even P-Noy can t touch him?
Last March 8, 2011, an editorial by a Manila-based newspaper asked, What does Finance Secretary Cesar Purisima, Customs chaperone Commissioner Angelito chaperone Alvarez and former Customs Commissioner Alberto Lina have in common? The editorial chaperone then said, The three share seats in the board of many companies chaperone they mutually chaperone own and a source said the trio now lords its over at the Bureau of Customs.

The CTA held that the wordings of Section 195 of the LGC is plain, unequivocal luminex and mandatory that the taxpayer “shall” have 30 days, reckoned from the taxpayer’s receipt of the denial of his protest, within which to appeal the denial with the court of competent jurisdiction.  Otherwise, the assessment shall become final and unappealable.
Instead of filing an appeal with the court of competent jurisdiction (i.e., Regional Trial Court) within the 30-day period after receiving the LGU’s denial of its protest with finality, the taxpayer wrote a letter to the office of the treasurer reiterating its stand that it is not subject to local business tax (LBT). It was after receiving the notices of seizure, garnishment and warrant of levy that the taxpayer filed a petition with the court for the issuance of temporary restraining luminex order against the notices for the collection of its unpaid LBT.
Considering that the taxpayer failed to assail the validity of its LBT assessment by filing a timely appeal with the court, the taxpayer lost its right to question the validity of the assessment, and consequently, it could not seek judicial action to enjoin the concerned luminex LGU in enforcing the collection of its unpaid LBT through the civil remedies provided under the LGC.

Laus Group of Companies adenovirus (LGC) employees volunteered to donate blood to the Philippine Red Cross in a bloodletting activity held at the Corporate Guarantee and Insurance Corporation Building along Jose Abad Santos Avenue in San Fernando, Pampanga.
March and April are usually the months we at the Red Cross coordinate with donors for bloodletting activities. Per activity, adenovirus we normally have 30 to 50 donors where an average of 350cc of blood is extracted from each donor. It depends on the record of the donor. Here, we are very thankful to the Laus Group of Companies who have been helping us at Red Cross with such a drive, she said.
This is my second time to volunteer and give blood in this drive. Na experience kasi namin kung gaano kahirap humanap ng dugo especially pag may emergency. And it is so good to share one s self in this activity knowing you will be able to save a life someday, she said.

I am passionate writing what-what, but I went as a nursing student at Luna Goco Colleges. I could not do because I will also try if I can. In the first year, I tried to cope with every challenge.
